Sponsorship, Co-Development and IP Investment Are Different Decisions

When an entertainment project asks your company to become a “sponsor,” the first question is not the amount. It is what your company receives, which decisions it controls, and which risks it accepts. Advertising sponsorship, co-development and IP investment should not be treated as interchangeable.

Consider a hypothetical beverage brand joining a new game-IP fan event. Paying for sampling and visibility is a sponsorship discussion. Building an interactive experience together is a co-development discussion. Providing capital in expectation of future IP returns is an investment discussion. The same project can involve all three, but each requires its own scope and approvals. FounderBank’s sponsorship and partnership page distinguishes these participation routes.

Route Potential value Decision to clarify
Advertising sponsor Audience contact, product trial, visibility Deliverables, measurement, permitted use of assets
Co-development partner Joint experience, promotion or operations Roles, costs, approvals, rights to deliverables
IP investor Capital participation Rights, risk, revenue structure and governance

This is a planning framework, not a confirmed project offer or investment recommendation. Contract, tax and investment decisions require project-specific review.

1. Separate the forms of participation

FounderBank's sponsor and partner page describes participation as advertising sponsorship, business partnership (joint planning), or investment (participation in an IP), or a combination of these. Responsibilities, expected effects, and internal approvals differ greatly depending on whether you are buying advertising exposure, joining the planning, or investing. State which form you are considering and align with the other side. If forms are mixed, separate the advertising part from the joint-planning part so that conditions are easier to compare.

2. Define your goals and how you will measure results

The page lists, as value for companies, acquiring visitor data, social media spread, and direct routes to products and services, and says the approach is designed for results rather than simply offering ad space. It does not, however, set out specific metrics. In such cases, decide on your side what counts as success. Depending on the goal, such as awareness, product trial, sign-ups, or inquiries, the indicators differ. When a numerical target is proposed, confirm what data it is based on and who will compile it, when, and how. If a proposal includes figures that suggest scale, you may ask for the supporting material.

3. Confirm the scope of usable rights and materials in writing

Sponsors often want to use event video, photos, or materials featuring performers in their own announcements. The permitted scope depends on what was agreed in advance. The Agency for Cultural Affairs' copyright contract manual advises obtaining consent at the time of the request for later uses such as recording and streaming, and notes that in the recording of performances, the initial contract strongly affects later use, so future uses should be anticipated when setting terms. List the types of materials, media, period, and regions as concretely as you can. Materials involving performers or works usually require approval from the rights-holding side, which a sponsor cannot decide alone, so ask who the approval contact is and how long confirmation takes.

4. Name who will use the materials, and how additional uses are handled

The same manual recommends adding to the contract any party other than the organizer who will use the work. If your affiliates, agencies, or retailers may use the materials, define who may use them and to what extent. It also advises stating what a fee is paid for and setting in advance the compensation for additional uses. Record how you would request and pay for uses beyond the original plan. Avoid relying on oral agreements, and review the content carefully before signing or sealing.

5. If investment is involved, review it with extra care

When participation includes investment, different points apply than for advertising. It is essential to check, in documents, how risk and return are structured, what materials are provided, and how rights and revenue are handled. FounderBank states that it designs each project individually and proceeds after making risk and return clear, but individual terms need to be confirmed for each project. This article does not recommend any investment and does not promise revenue or results. Please decide on investment matters based on the documents presented and, as needed, consult a lawyer, tax adviser, or accountant.
