Permission to Use an IP Logo Is Not the Same as Trademark Clearance Overseas
Imagine an overseas organizer proposing a fan event and limited-edition merchandise using a Japanese anime title and logo. Approval to use the artwork for an event does not, by itself, establish the trademark position in the target market or cover every product and sales territory. This is a hypothetical planning scenario, not a claim about a completed FounderBank project.
Four questions to settle before announcing the project
| Question | What to document |
|---|---|
| Which name? | Title, translated title, event name, product name and approved logo version |
| Where? | Event location, online sales destinations and streaming territories |
| For what? | Live event, merchandise, video and any planned future uses |
| Who checks? | IP owner, local organizer, distributor, trademark specialist and final approver |
Keep the scope of an IP licence separate from trademark availability and registration in each jurisdiction. A popular Japanese title is not necessarily free of conflicting rights overseas. WIPO recommends searching existing and pending trademarks in target markets before filing. For example, Madrid System protection designated for China does not extend to Hong Kong or Macao.
International registration does not automatically guarantee protection
Japan’s Patent Office explains that the Madrid System lets eligible applicants seek protection in designated members using a Japanese basic application or registration. Each designated IP office examines the mark under local law. An international registration does not guarantee protection in every market. The Madrid Protocol also includes a five-year dependency on the basic mark. Whether to file nationally or through Madrid requires jurisdiction-specific professional advice.
A practical handoff for an overseas IP event
- The project producer defines the experience, markets, products, timeline and proposed names.
- The IP owner clarifies the proposed licence scope and approval process.
- The local organizer identifies actual sales and promotional territories.
- Qualified trademark counsel assesses searches, filing routes and legal questions.
- The production team tracks unresolved approvals and avoids announcing unapproved rights or guaranteed outcomes.
