Before Using Music in a Japanese Anime or Game Co-Production: Five Rights Checks for Companies
Clearing a song does not automatically clear a commercial recording of it. For anime and game co-productions, treating the composition and the master recording as one asset can lead to late-stage replacement. A newly recorded cover and the use of an existing commercial master involve different parties and agreements. This guide uses JASRAC’s published guidance to show production teams how to separate those checks before committing to a track.
This article is a general overview and not legal advice. Please confirm whether a specific track or contract is permissible with the rights holders or a qualified professional. It also covers the Japanese copyright framework only; releasing or streaming overseas may involve the laws of other countries.
A new recording and an existing master are different choices
Hypothetical example: a Japanese game studio and an overseas publisher want to use an existing song in the ending sequence. A new recording requires checking the song rights and the new recording and performer agreements. Using an existing commercial master also requires checking rights in that specific recording. Neither path can be cleared simply by saying that the song itself is approved.
1. Treat the song and the recording as separate rights
JASRAC explains that lyricists and composers hold copyright, while performers and record producers (such as record companies) hold neighboring rights. For example, copying sound from a commercial CD to use as background music in a video involves the record producer's reproduction right, so permission is needed. Even for a single piece of music, the parties to check differ between the song itself and the recording of a particular performance.
In a co-production, it helps to assume from the moment someone says "let us use this track" that both the song's rights holders and the recording's rights holders must be checked. This reduces rework later.
2. List the tracks and how they will be used
This step is a general suggestion, not drawn from the sources. List the music used in the work, and write down in which scenes, in which formats, and in which regions and periods it will be used. According to JASRAC, copyright is divided into rights such as performance, reproduction, and public transmission, and permission is needed for each type of use. Listing uses that may be added later, such as trailers or streaming, from the start helps avoid gaps.
- Track title, lyricist and composer, and the scene where it is used
- Format of use (video, in-game, trailer, event screening, and so on)
- Release regions and period
- Whether it is an original track, an existing song, or an existing recording
3. Check how the rights are managed
JASRAC's guidance for using music in recordings and video products starts with checking the rights in its work database, J-WID, and confirming the management category for reproduction. For tracks not managed by JASRAC, you contact other copyright management organizations, music publishers, or the authors directly. Because JASRAC manages rights within the scope designated by rights holders, the same track may be licensable for one use and not for another.
Note that an application to JASRAC concerns the song (the work). When using a commercial CD or a downloaded recording, JASRAC states that separate permission from the recording's producer, such as the record company, is required. For in-game use, JASRAC also publishes a dedicated game production guide, which explains checking the game’s management category in J-WID and discussing terms with the relevant rights holders. Game streaming may involve separate procedures, and overseas screenings require checks appropriate to the actual use.
4. Check arrangements, altered lyrics, existing recordings, and protection periods
JASRAC states that it has not received the arrangement and adaptation rights for arrangements, altered lyrics, and translated lyrics, so you need to ask the author or the music publisher directly. In games and anime, arranging an existing song or replacing lyrics for an overseas version may be considered, and these are items where the rights holder's intentions should be confirmed in advance.
Songs under exclusive contracts may require a separate release procedure, and for foreign songs a music publisher may specify the fee. Sharing quotes and decision schedules early makes it less likely to disrupt the overall production plan.
Protection periods also matter. JASRAC explains that copyright generally lasts until 70 years after the author's death, and that performances and records have their own separate protection periods. Even if a song's copyright has expired, other rights may remain in a recording of a particular performance.
5. Decide roles and keep records
This is also a general suggestion. In a co-production, it is important to settle in a contract or memorandum who obtains permission, who bears the cost, and who manages the scope of permission. Keep the details of each permission (tracks, uses, regions, period) in a form that leaves a record, such as documents or email, so you can refer to them if you expand the use after release. JASRAC also explains that infringement may lead to civil liability, such as injunctions and damages, as well as criminal liability.
