Before Deciding Credits in a Japan Co-Production: Five Points on the Right of Attribution

When companies co-produce anime or games with Japanese creators, the question of how names appear in the staff roll, on the official site, or on packaging is often left until the end. Authors, however, hold a right of attribution, so whether a name appears and under which name should be agreed in advance. This article organizes what corporate clients and co-producers may want to settle before signing. It is general information, not legal advice; please consult legal counsel in the relevant jurisdictions.

What is the right of attribution?

The right of attribution lets an author decide, when a work is made public, whether to show a real name, a pseudonym, or no name at all. A lawyer-supervised contract explainer (Money Forward Cloud Contract, updated March 27, 2026) describes it as a right under Article 19 of Japan’s Copyright Act, and notes that it also relates to how an original author is credited when a derivative work is published. The same page says that omitting an author’s name can be acceptable if it does not harm the author and does not conflict with fair practice, citing background music as an example.

The Agency for Cultural Affairs’ contract manual states that when a work has already been published with a settled credit and is used exactly as credited, the credit need not be written into the contract. For unpublished works, or when the way of crediting is changed, the manual says the method should be agreed with the author, and it describes performers’ name credits in the same way.

Five points to confirm before a co-production starts

1. Who decides the list of credited people. Employees, subcontractors, performers such as voice actors, and music or asset providers may all be candidates. Decide who compiles the list, who gives final approval, and until when it can be updated. (This is a general practical point, not drawn from a specific source.)

2. Name and format, based on each person’s wishes. The choice between a real name, a pseudonym, or no credit rests with the author. Also decide whether the format differs by medium: staff roll, official website, packaging, streaming pages, or event materials.

3. Agree in advance on unpublished works and format changes. As the manual above indicates, using unpublished works or changing how a name is shown calls for an agreement with the author. Record when, on which media, and under which name credits will be used.

4. Handle moral-rights non-exercise clauses with a clear scope. Copyright can be transferred, but moral rights cannot. Both sources say contracts sometimes include a clause under which the author agrees not to exercise moral rights. The Money Forward explainer recommends defining the covered work and naming who benefits, and notes that such a clause does not permit uses that damage the author’s reputation. The manual also says changes to content or title require the author’s consent and should be stated in the contract, and that a specific release date should be written into the contract if it matters.

5. Corrections, changes, and a final approver. Credit errors and post-release name-change requests can happen on any project. Decide who receives such requests, who approves them, and how quickly each medium will be corrected. FounderBank’s co-development guide likewise lists naming final decision-makers, documenting decisions, and setting an escalation route as basic working practices.
