How to Commission Anime and Game IP Merchandise in Japan: Purpose, Approvals, Regulations and Ordering Terms
Merchandise based on anime or game IP can be sold at events, sold online, offered as campaign prizes, or handed out as novelties. Each use calls for different preparation. If the purpose and the scope of rights are unclear when you approach a manufacturer, quotes are hard to compare, revisions pile up at the design and sample stages, and the schedule can slip past an event or launch date.
This guide is for marketing managers, event organizers and business teams at game or anime companies. It covers what to prepare before commissioning merchandise, the typical production flow, how to think about cost and schedule, and rules in Japan that are easy to overlook. Costs, lead times and contract terms vary by project, so please confirm them case by case.
1. Decide the purpose and the scope of rights first
Start by deciding whether the items will be sold, given away free, or used as campaign prizes. The purpose affects the applicable rules, quantities, quality standards, packaging and delivery.
Next, confirm the rights. If your company owns the IP, internal sign-off may be enough. If you are using another company’s IP, the scope of merchandising rights (product categories, territory, term, sales channels) is set by your agreement with the rights holder, and designs are usually subject to the rights holder’s review and approval. The number of review rounds and the time each takes directly affect your schedule. Whether a license is granted, and on what terms, is the rights holder’s decision, so check this before production begins.
What to organize before you ask for a quote
- Purpose and sales channels (event sales, e-commerce, prizes, novelties, internal use)
- The IP to be used and the status of merchandising rights (secured, in negotiation, undecided)
- Candidate items and their priority
- Approximate quantity and maximum budget
- Target delivery date and any fixed dates such as events or launches
- Expected age range of buyers or recipients
- Delivery address, shipping regions and whether storage is needed
2. The typical production flow
Planning and item selection
Narrow down feasible items based on purpose, budget, quantity and deadline. Materials, finishing and individual packaging all change what a given budget can buy, so requesting quotes for several specifications makes comparison easier.
Design and approval
Create designs, then go through internal review and the rights holder’s approval, revising as needed. Confirm the submission format, contact point and review time at the outset.
Samples and mass production
Before mass production, check color, size, print position and material on a sample. Samples may also require approval. Mass production starts after sign-off.
Inspection, packing and delivery
Agree on inspection criteria, such as acceptable tolerances and how defects are handled, in advance. Packing and shipping arrangements depend on whether goods go straight to a venue or to a warehouse.
3. Thinking about cost and schedule
Unit prices depend on quantity, materials, finishing and packaging. When comparing quotes, check whether costs are broken down by stage: design, approval handling, samples, tooling if needed, production, inspection, packing, shipping and storage.
Build the schedule backward from the event or launch date, and leave room for approval revisions, remade samples and defect handling.
4. Rules in Japan that are easy to overlook
The following is general information about Japan and is not legal advice. Please consult a lawyer or the relevant authority about your specific case.
Prizes and giveaways (Act against Unjustifiable Premiums and Misleading Representations)
According to Japan’s Consumer Affairs Agency, premiums given to all purchasers are capped at 200 yen when the transaction value is under 1,000 yen, and at two-tenths of the transaction value when it is 1,000 yen or more. For prize draws, the maximum prize is 20 times the transaction value when it is under 5,000 yen and 100,000 yen when it is 5,000 yen or more, and the total value of prizes is limited to 2% of the expected sales related to the draw.
Toys for children under three (Consumer Product Safety Act)
According to Japan’s Ministry of Economy, Trade and Industry, new rules for toys intended for children under three took effect on December 25, 2025. Manufacturers and importers must confirm conformity with national technical standards, display warnings such as the target age, file a notification and display the Child PSC mark. Covered toys without the mark cannot be sold. If you plan items such as plush toys, check whether they fall under these rules.
Ordering from manufacturers (TorITEKI Act)
According to Japan’s Fair Trade Commission, the amended Subcontract Act took effect on January 1, 2026, and is now commonly called the Toriteki Act. It covers transactions such as manufacturing consignment, and whether it applies depends on the parties’ capital or number of employees and the type of transaction. Where it applies, the ordering party must clearly state order details, set a payment date within 60 days of receipt, and keep transaction records for two years; payment by promissory note is prohibited.
5. Pre-order checklist
- The purpose (sale, free distribution or prize) and sales channels are decided
- The rights holder and the scope of merchandising rights are confirmed
- The approval contact, submission format and review time are known
- Candidate items, approximate quantity and maximum budget are organized
- A schedule worked back from fixed dates is in place
- Prize value limits and age-related product rules have been checked
- Inspection criteria and delivery methods are agreed
